Terms of Service
Draft for legal review. Placeholders in yellow are completed before publication.
- Otilie helps you track how your skin looks over time. It's not a medical service and doesn't diagnose or treat anything.
- Subscriptions are sold and billed by Apple. They renew automatically until you cancel in your Apple account settings. Deleting the app doesn't cancel them.
- Your data is yours. We only use it to run Otilie for you — see the Privacy Policy.
- If you live in the EU, you keep all the protections of your country's consumer law.
1. About these terms
These terms are an agreement between you and Miguel Ridruejo Mendoza (“Otilie”, “we”), Calle de Elisa 24, 08023 Barcelona, Spain, tax ID 02585581J. They apply together with our Privacy Policy. The app itself is licensed to you under Apple's Standard Licensed Application End User License Agreement; these terms add the rules specific to Otilie. You must be 16 or older to use Otilie.
2. What Otilie is — and isn't
Otilie is a cosmetic and wellness app. It estimates visible changes in how your skin looks — redness, blemishes, texture, dark spots, fine lines and under-eyes — and helps you build and test a skincare routine.
- Not medical advice or a medical device. Otilie doesn't diagnose, detect, treat or prevent any disease or condition, and its scores aren't medical measurements. Always talk to a doctor or dermatologist about anything that worries you, and seek urgent care for sudden or severe symptoms.
- Scores are estimates. They depend on lighting, camera, angle, distance, makeup, facial hair and other factors, and may be less reliable for some skin tones and conditions. We design for consistency, not perfection. Small changes (shown as “Same”) are within normal day-to-day variation.
- Product suggestions are general guidance based on ingredients and your answers. Patch-test new products and stop using anything that irritates your skin.
3. Your account
You can use Otilie without an account. If you create one, keep your sign-in method secure and tell us if you think someone else has access. One account is for one person. You can delete your account and data at any time from the app.
4. Subscriptions and free trials
- Apple is the seller. Purchases are made through the App Store and billed to your Apple account. The price, billing period and any free trial are shown before you buy.
- Automatic renewal. Your subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Free trials convert to a paid subscription when they end unless you cancel at least 24 hours before. We'll remind you before your trial ends.
- Cancel anytime in Settings → your name → Subscriptions on your iPhone. Cancelling stops the next renewal; you keep access until the end of the period you've paid for. Deleting the app doesn't cancel your subscription.
- Refunds are handled by Apple under its policies, including the 14-day right of withdrawal for EU customers. You can request one at reportaproblem.apple.com.
- Reminders and price changes. We'll remind you before an annual subscription renews, and you'll be told about any price increase in advance and asked to accept it where the law requires.
- If a subscription ends, your history stays readable; new scans and the coach pause until you subscribe again.
5. The AI coach
When available, the coach is an AI, not a person or a dermatologist. Its answers can be incomplete or wrong; use your own judgement and don't rely on it for medical decisions. It won't answer questions that need a doctor and will point you to one instead. Don't use it to seek diagnosis or treatment, and don't share other people's personal data with it.
6. Product information and shopping
Product and ingredient information may come from Open Beauty Facts, available under the Open Database License; it can be incomplete or out of date. When Otilie shows product options, they're ranked only by how well they fit your routine. We may earn a commission if you buy through a link, and that never changes the order. Purchases from other sellers are under their terms.
7. Your content
What you log in Otilie is yours. You give us only the permission needed to store and process it to provide Otilie to you, which ends when you delete it or your account. We don't use your content to train AI models or for advertising.
8. Fair use
Don't misuse Otilie: no attempts to access other people's data, reverse-engineer or disrupt the service, scrape it, or use it for anything unlawful. We may suspend accounts that do, after warning you where reasonable.
9. Our content
Otilie's app, design, text and software belong to us or our licensors. You may use them only as part of using Otilie.
10. Changes and availability
We keep improving Otilie and may change features. We'll give you notice in the app before changes to these terms that affect you, and before discontinuing a paid feature. If you don't agree with a change, you can stop using Otilie and cancel your subscription.
11. Liability
We provide Otilie with reasonable care and skill. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for wilful misconduct or gross negligence, or any liability that can't be limited by law, and nothing affects your statutory rights as a consumer. Otherwise, we're not liable for losses that weren't foreseeable, or for decisions about your health or skin made on the basis of the app instead of professional advice.
12. Law and disputes
These terms are governed by Spanish law. If you're a consumer, you also keep the mandatory protections of the law of the country where you live, and you can bring proceedings in the courts there. We'd always rather resolve a problem directly first: write to hello@otilie.app.
